Terms of Sale

Article 1 - Purpose

These Terms of Sale define the rights and obligations of the parties in connection with the online sale of products offered by The Literalist (L'expressionniste) (t-shirts, mugs and other textile or decorative items).

Article 2 - Price

Our product prices are shown in euros, all taxes included, excluding delivery costs. They take into account the VAT applicable on the day of the order.

The Literalist (L'expressionniste) reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed.

Free delivery: Delivery is free for any order over €50 within mainland France.

Article 3 - Order

The Customer places an order on the site by following this process:

1. Selection of the product(s)
2. Confirmation of the cart
3. Entry of delivery information
4. Choice of payment method
5. Confirmation and payment of the order

The sale will only be considered final once the Customer has received email confirmation that the order has been accepted, and after the full price has been collected.

Article 4 - Payment

Payment is made securely online via the Shopify platform. The accepted payment methods are:

• Credit card (Visa, Mastercard, American Express)
• PayPal
• Apple Pay / Google Pay

Payment is secured by the SSL protocol. Bank details are not stored on our servers.

Article 5 - Delivery

Delivery time: Products are made to order (print on demand). Production time is 5 to 7 business days, plus shipping time.

Estimated total time: 7 to 10 business days for mainland France.

Delivery areas: Mainland France and the European Union. Delivery costs are calculated based on the destination.

In the event of a delivery delay of more than 30 days, the Customer may request cancellation of the order and a refund.

Article 6 - Right of withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products manufactured to the consumer's specifications or clearly personalized. As all of our products are made to order (print on demand), they are excluded from the right of withdrawal.

In the event of a printing defect or non-conforming product (quality defect, manufacturing error), we undertake to replace the product or refund you in full. Contact us at contact@lexpressionniste.fr with a photo of the problem within 30 days of receipt.

Article 7 - Warranties

Warranty of conformity: All our products carry the statutory warranty of conformity (articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).

In the event of a defect of conformity, the Customer may request replacement or a refund of the product within 2 years of delivery.

Article 8 - Liability

The Literalist (L'expressionniste) cannot be held liable for non-performance of the contract in the event of a stock shortage, product unavailability, force majeure, or total or partial disruption or strike affecting, in particular, postal services and means of transport.

Article 9 - Intellectual property

All elements of the website literalist.lexpressionniste.fr are and remain the exclusive intellectual property of The Literalist (L'expressionniste). Any reproduction, use or distribution, even partial, is prohibited without prior written authorization.

The illustrations featured on the products are original creations protected by copyright.

Article 10 - Personal data

Personal data collected when placing an order is necessary for processing the order and may be communicated to partners responsible for order fulfillment, processing, management and payment.

Article 11 - Disputes and mediation

In the event of a dispute, the Customer may use a consumer mediator free of charge to seek an amicable resolution of the dispute. The mediator's contact details will be provided upon request.

Online mediation: European online dispute resolution platform: ec.europa.eu/consumers/odr

Failing an amicable settlement, any dispute will be brought before the competent French courts.

Article 12 - Applicable law

These Terms of Sale are governed by French law. The language of these Terms of Sale is French.
